These terms and conditions (“Terms of Service”), govern the use of the broking service (“Service”) provided by Rivers Funding Limited (“we”, “us”, “our”) to any business which registers with us for the Service in accordance with these Terms of Service (“you”, “your”).
Rivers Funding Limited is registered in England and Wales (company number 10843425) and has its Registered Office at Amba House, 15 College Road, Harrow, Middlesex, United Kingdom, HA1 1BA.
We are a broker, not a finance provider. We broker commercial funding arrangements for companies and do not offer the Service in respect of any Financial Conduct Authority (FCA) regulated activity. Therefore Rivers Funding is not registered with the FCA.

Please note
- Our Service is intended for your own business-related purposes only.
- We do not provide debt counselling or debt advice. If you would like support in this area, you could consider contacting Business Debtline.
- We cannot guarantee that our Service will be successful for you, neither are we obliged to provide our Service to you.
- It is your responsibility to ensure that any options presented to you through the Service meet your requirements.
- We only offer the Service to companies in relation to unregulated commercial lending- Please do not apply if you are a consumer, partnership or micro-business.
Appointment
- You can request us to provide the Service by completing the application form available at www.riversfunding.com (Website). You will need to accept these Terms of Service in order to submit the application and receive our Service. At the end of these Terms of Service is a list of the information we usually require when submitting the application.
- Once you submit the application form, you will receive an email from us confirming the application has been received and we will be appointed as your broker from that point in time.
- Either you or us may cancel the appointment and our agreement immediately at any time by giving written notice by email, using the contact information provided on the Website or in your application.
Funding
- We provide the Service in relation to funding and credit options available from our group company Rivers Leasing plc (Lender). All applications will be forwarded to the Lender who will be responsible for assessing your application and determining if funding may be available.
- We will communicate with you within 2 working days to confirm whether the initial application has been successful or not. If it is successful, you will be referred directly to the Lender who will undertake further assessments, due diligence and checks in accordance with the Lender’s usual terms and conditions.
- We do not undertake any identity, Know Your Client or other checks following the application being submitted. These will be carried out by the Lender if your initial application is successful and moves to the next stage.
You acknowledge
- We will source funding products from the Lender and in this role, we are doing no more than effecting an introduction between you and the Lender to enable you to choose a funding product which, in your sole opinion, is suitable for you. We are not your agent or otherwise acting on your behalf, and there is no duty upon us to provide you with impartial advice, information or any recommendation relating to a funding product.
- We may receive a commission from the Lender for introducing you to them in relation to a funding product. If you wish to receive any further information concerning any commission paid to us by the Lender, please let us know in writing. You hereby consent to us receiving and retaining any Commission paid.
- By using the Service, you agree to notify us promptly of any changes in the details you have provided to us. You shall ensure that all information you provide to us is complete, true, up-to-date and accurate in all respects.
- You agree to act with utmost good faith in the provision of information to us and otherwise in receipt of the Service.
Our management of data
- We take data protection very seriously and we are committed to taking care of your business data in accordance with the provisions of our Privacy Policy available at [insert URL].
- As part of providing our Service to you we may share data provided by you with the Lender, who in turn will share with us information regarding your application, as relevant for your initial assessment.
Client money
- For the avoidance of doubt, Rivers Funding does not hold or in any way handle any client monies.
Liability
- We expressly exclude liability for any inaccuracies or errors to the fullest extent permitted by law in relation to information relating to the funding product(s) offered by the Lender.
- We shall have no liability for any indirect loss suffered or incurred by you, including without limitation loss of business, loss of data, interruption of business, or loss of profits or damage to goodwill because of the manner of performance the Service or otherwise related to our appointment under these Terms of Service.
- Nothing in these Terms of Service shall seek to exclude or limit liability for death or personal injury or any other liability that cannot be lawfully excluded or limited.
- The Service is not intended as advice or to be relied upon by you in any way, including as the basis for making or not making any decision, and you should obtain your own independent financial, accounting, tax and/or legal advice concerning your activities in connection with the Service and any finance application and/or agreement.
- You agree to indemnify and hold us, our staff, officers, group companies and partners harmless from loss, damage or claims made by third parties and/or incurred as a result of your breach of these Terms of Service.
Other terms
- We reserve the right to vary these Terms of Service at any time by giving notice to you.
- We may assign, transfer, subcontract, charge, delegate or otherwise deal with our rights and obligations under these Terms of Service.
- These Terms of Service and our appointment is personal to you and your rights and obligations under them may not be assigned, transferred, charged, delegated or otherwise dealt with, without our prior written permission.
- If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain enforceable.
- Failure to exercise or enforce rights or provisions under these Terms of Service by us shall not constitute a waiver. All waivers must be in writing.
- Your use of the Service is subject to English law, and we both agree to submit to the jurisdiction of the English courts to settle any dispute that might arise.
